  1. Daniel Nicholson says:

This Personal Property Trust can also be used as an asset protection tool similar to a Land Trust – for holding title to valuable non real estate assets such as vehicles, boats, airplanes, etc. Instead of registering / titling one’s property in your personal name, title it in the name of a trust and the Trustee’s name. Thus no attorney can search the public records to discover valuable property owned in your name.

Big thanks for that info Daniel.

  3. Richard Mc Calla says:

Am I correct in assuming that you would use this Trust for an option on Real Estate rather than 3)Trust Agreement because an option is not a debt instrument?

  4. Dan Nicholson says:

This particular trust agreement is worded to provide for management of investments. My earlier comments about registering / titling property into a Personal Property Trust were meant to apply to valuable personal properties other than investments – such as cars, boats, airplanes, etc. which can be attached by creditors via a court judgment. The clauses of such an agreement would necessarily need to be modified to describe the duties and responsibilities of the Trustee regarding trust assets. The investment management clauses of this particular agreement would be deleted, and others substituted as required to suit the objectives of the specific Personal Property Trust being created.

Do you need to file this anywhere with the county?

Thank you! I found this by typing ‘Personal Property Trust’ in the search field under ‘Resources’ because I want to buy a nice car and put it in a trust after learning what Ron teaches in the Asset Protection Video. I love this Gold Club site. It covers all our bases…even non real estate related things!

Q: Hoping someone can help me with this. I am separating from a partner and I took possession of his truck because he was in dispute with the state over taxes. They threatened to seize his “assets’ so until we could get it worked out, I own the truck. Now that we are separating and he still can’t “own” the truck I was wondering how to structure it by using a PP trust. Do I place it in the trust and assign beneficial interest to him? Who should be trustee? Does this protect me from liability involving the truck?

Disclaimer: This is not to evade taxes. The state is being unreasonable and until now would not accept a payment plan like he has with the IRS. They seem to be more receptive recently so we are hoping to get this resolved. Still better for him to use the trust anyway even when the state is not a threat.

    Thank you!

A personal property trust can own the membership interest in the LLC that either owns real estate directly or owns the beneficial interest in a land trust, according to Anderson. Fascinating.
