    Great form.

  2. KJ Roberts says:

I’m not 100% on this form understanding the use of it.

  3. Karen Murphy says:

This is not a “form” it is an assortment of CYA clauses to put in various contracts, where ever applicable

  4. Michael Minnihan says:

These are four optional clauses to add to either the mortgage or the note.

Due On Sale Clause #1 (put in mortgage)
Due On Sale Clause #2 (put in mortgage)
Collateral and Late Fee Clause (put in the note)
Attorneys Fee Clause (put in the note)

You use these clauses if you want to be paid if your buyers sell or assign the property.
You use the note clauses so you get paid late fees and if you need to get an attorney involved.

  5. Roberta Eastman says:

I searched for but didnt find anything regarding “personal guarantee” wording. Is there a specific clause to use for that or are we just asking our lawyer to put language in our docs indicating Tenant Buyers/Buyers are personally guaranteeing their notes/option agreements to us?

    Thank You…

    Good stuff!

  7. Roger & Lu Young says:

These are great clauses and should be used in every situation that they cover. They can save you tons of time, money and legal fees. Thanks.

Major Legaleeze required to make sure we get paid if your buyer sells or refinances!!

  9. Fatumata Sillah says:

would like an updated protection clause.

  10. Cyrus Julian says:

While I obviously agree with the intent of these clauses, it’s a bit ironic considering when we buy on terms, we want this to be as loose as possible for us to buy creatively.
