Your tenant buyer can L/O the property to someone else?? What?!!! How’s that work?

  5. Rebecca Negrete says:

Thank you for answering my question, however, I am in VA and the attorney I have consulted with told me that in order to put a tenant buyer or a renter in I would have to do a sublease and give them a copy of my Lease Option agreement with the seller. The difference in prices would be my termination fee from the seller. This confuses me though because my terms with the seller are different than the tenants terms with me. He also mentioned that I would do a lease option with the seller, but a lease purchase with the buyer so they are obligated to buy the property, but I am not. Any thoughts?

  6. Rebecca Negrete says:

The attorney said there are issues with the lease agreement I had with the renter since I am not the owner of the property and the same question has come up with a potential buyer. One mentioned I would need a Power of Attorney to lease/sell a house I do not own. I thought we only did that if we were taking title so I am thoroughly confused…

      Rebecca,

I’m going to take your followup question to Ron, but I think he’s going to tell you that you need a new attorney! Find one that’s on board with what real estate investors do.
