This is a Canadian slanted document. “Provincial” authorities §5(B), “solicitor’s trust checque.” There must be an American version in here somewhere. Just be advised that if a clause is questioned in court, the judge will go against the party who wrote or offered the contract, i.e., YOU.

  6. Noor Rahmani says:

Thank you Ron, this is Priceless…

  7. Timothy Manning says:

Thanks for the form. It covers EVERYTHING.

  8. Robert Black says:

I’m confused about what to take to the FSBO to sign to get the deal started. I understand that you need the form with the table of contents ( Real Property Possession and Lease Agreement) for ACTS deals and
the other form for a Sandwhich Deal ( Lease Agreement With Option to Purchase Real Estate). What form do we use to meet with the FSBO seller to get started?

    • Mark Burton says:

Robert, I know it can get confusing. Here’s the rundown. There is 1 long and 1 short Lease Option form WITHOUT a table of contents to use with US sellers. There is 1 long and 1 short Lease Option form WITHOUT a table of contents to use with sellers in Canada. Depending on where you are and depending on your seller, you can use the long or short WITHOUT a table of contents. The long form WITHOUT a table of contents covers a little more than the short form WITHOUT a table of contents. Some sellers can get scared off by long forms. If so use short. Both work fine in tying up a house. But never use the long “table of contents” Lease Option form with the seller. The long “table of contents” Lease Option form is only used with your buyer (whether you stay in the deal… sandwich lease option, or you assign your deal… ACTS) since it has a lot of provisions protecting you and anyone else you might assign it to. NOTE ON ASSIGNING DEALS: Ron and The Wolff Couple, and many other investor-teachers are now advocating that we stay in nearly every pretty house deal we get under contract. Even deals that would have been ACTS deals that we would have assigned just a few years ago. If it’s worth assigning, it’s worth keeping. If you can think of examples that contradict that last statement then you are probably about to describe a deal that Ron would call a “golden turd” – remember that Ron wants us to gather the low-hanging fruit. Sure you can make a little bit of money on marginal deals, but in the same time you spend on the marginal stuff, you could be working on the easier stuff (with less effort, hassle, liability, costly entanglements, etc) and making more money in the long run.

Canadian version. The tip off is anytime you see the word solicitor (paragraphs 14&20) instead of attorney; or you see the word cheque (paragraph 14) instead of check.

  10. Nathan Lumpkin says:

Where does it state in this form that we are able to walk away from the deal at any time without being held to the terms? Is it in Section (2) where we state our intent to terminate the Lease/Option with the Seller?

  11. Joe Roach says:

Hoping to use this again and again, thank you!

  15. Kevin Smith says:

    Hello all,

Working on my first deal. I have a couple of questions on the short form agreement. What goes in line 3 for the credit that’s applied to the purchase price.

Not sure about line 9 not understanding whats suppose to go in the blanks.

And last but not least line 13 Special provisions. I guess I can just leave blank if no provisions are needed.

Any help would be greatly appreciated thanks.

  16. Christopher Doran says:

Hi does anyone know why there is no option fee mentioned in this agreement anywhere please? Is it that the rental payment due is the consideration hwereas in a staright option agreement only there is no rental payment and so an option fee is necessary to act as the consideration? Thanks.
